These Terms of Service (the “Terms”) apply to the use of www.contourose.com and any related websites (“Website" or "Websites") owned and operated by C-DISTRIBUTION P.S.A. (the “Company”, “Contourose”, “we”, “us” and “our”), a company registered in Warsaw, Poland, with its registered office at Aleje Jerozolimskie 96, 00-807 Warsaw, entered into the Register of Entrepreneurs kept by the Regional Court in Warsaw, XII Department of the National Court Register under the number KRS 0001152218; Tax ID (NIP): 7011243678; EU VAT number: PL7011243678.

The Terms govern your access to and use of the Website, our services, content, and your purchase, receipt, or use of any products offered through the Website (collectively, the “Products”).

By accessing or using the Website, or by purchasing our Products, you agree to be bound by these Terms together with our Privacy Policy, Shipping Policy and Returns Policy. If you do not agree, you may not access or use the Website or purchase our Products. We recommend that you keep a copy of these Terms for future reference.

These Terms apply to all sales and delivery contracts concluded with Contourose through the Website. All such contracts are distance contracts concluded without the simultaneous physical presence of the parties, using means of distance communication.

We may update these Terms from time to time, for example to reflect changes in our business operations or to comply with applicable law. Please review the Terms regularly to ensure that you are aware of the current version. If you do not agree to any updated Terms, you are free to reject them, but in that case, you may not access or use the Website or order, receive or use the Products. Any changes made after you have placed an order will not affect that order, unless we are required to apply the change by law.

We reserve the right to only accept orders from those over eighteen (18) years of age.

Contourose is not obliged to verify the accuracy or authenticity of the information provided by the Customer, and shall not be held responsible for any consequences arising from false or incorrect data submitted.

You may browse and purchase through our Website as a guest. However, creating an account provides you with additional benefits, among others, tracking your orders and accessing order history, submitting return requests, collecting rewards, and managing your account details and email preferences.

Account registration and sign-in are powered by Shopify’s secure one-time access system. Instead of using a password, you will receive a single-use login link or code sent to your verified email address each time you access your account. You are responsible for ensuring that the email address provided is correct, secure, and accessible only to you.

When creating or accessing your account, you agree to provide true, accurate, current, and complete information and to keep it up to date. Your account is personal and cannot be transferred or shared with others.

We reserve the right to suspend or terminate accounts that contain false information, are used fraudulently, or otherwise violate these Terms. If you experience any issues accessing your account, please contact our Customer Service at support@contourose.com.

You are solely responsible for maintaining the security of your email account and for preventing unauthorized access to your Contourose account. Because access is granted through one-time login links or codes sent to your verified email, anyone with access to that email account may be able to access your Contourose account as well. Contourose is not responsible for any unauthorized access resulting from compromised email credentials or failure to secure your device. If you suspect any unauthorized use of your account or unusual activity, please notify us immediately at support@contourose.com so we can help secure or deactivate your account.

Contourose sells its products exclusively online through the Website. To place an order, you must have an active email account and complete the checkout process, including providing accurate billing and shipping information, selecting a delivery option, and choosing a payment method.

All information and product descriptions provided on the Website are for informational purposes only and do not constitute an offer within the meaning of applicable civil law. By clicking the “Pay now” button at checkout, you submit an offer to purchase the selected Products. Orders are subject to acceptance and product availability. Please note that items in your shopping bag are not reserved and may be purchased by other customers until the order is confirmed.

Once your order has been received, you will receive an email acknowledging receipt of the order. Please note that this acknowledgment does not constitute acceptance. The contract of sale is concluded only when you receive a subsequent email confirming that your order has been accepted and dispatched.

If for any reason we are unable to fulfill your order, we will inform you as soon as possible. If payment has already been made, we will refund the applicable amount using the same payment method, unless we agree otherwise with you.

We reserve the right, at our sole discretion, to limit the quantity of items purchased per person, per household, or per order. These restrictions may also apply to orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing or shipping address. We also reserve the right to prohibit sales to dealers, resellers or distributors.

From time to time, we may make selected Products available for pre-order before they are released for regular sale. By placing a pre-order, you acknowledge that our Terms of Service apply to pre-orders, supplemented by the specific conditions set out in this section.

When placing a pre-order, you will be required to pay the full purchase price of the Products together with any applicable delivery costs at the time of ordering. Your contact details must be accurate and kept up to date in order for us to inform you of the status of your pre-order.

The estimated shipping date for pre-ordered Products will be indicated on the relevant product page and confirmed in your order confirmation email. Please note that such dates are indicative and may be subject to change. We are not liable for any delay or change to the expected launch or shipping date. If the launch or shipping date is delayed beyond the date originally communicated, you will have the right to cancel your pre-order and receive a full refund.

Pre-ordered Products are subject to availability. While we make every effort to fulfil all pre-orders, circumstances such as production limits or supply chain constraints may result in our inability to deliver all pre-ordered items. In such cases, affected pre-orders will be cancelled (in whole or in part, as applicable), and any amounts already paid for Products that cannot be delivered will be refunded using the original payment method. We are not liable for any further compensation related to the unavailability of pre-ordered Products.

Each Contourose piece is carefully handcrafted. Due to the artisanal nature of our production, subtle variations in stitching, finish, or the arrangement of each design element may occur between individual items. These characteristics are not defects but a natural part of the handmade process that makes each piece unique.

Prices shown on the Website are displayed in Euros (EUR €) or United States Dollars (USD $), depending on the version of the Website you are viewing. Prices include value added tax (VAT) where applicable, unless you have selected a shipping destination where VAT is not chargeable. For certain countries, customs duties and import taxes may apply. Prices do not include delivery costs unless expressly stated otherwise at checkout. Delivery charges will be displayed before you confirm your order. Further information can be found in the Shipping Policy.

The payment currency is determined by the regional settings of the Website and may also depend on your device settings. To ensure accurate pricing, taxes and delivery costs, we recommend that you select your shipping country and currency preference from the menu available on the Website.

All prices and offers are valid as displayed on the Website at the time you place your order. The price of a Product shown in the correct currency at the time your order is accepted will be honored, except in cases of obvious error.

Payment for Products purchased through the Website must be made using the payment methods made available at checkout. We generally accept major credit and debit cards (including Visa, Mastercard and American Express) as well as other payment methods such as Klarna. Available payment methods may vary depending on your location and may change from time to time. The options available for your order will always be displayed during the checkout process.

You confirm that the credit or debit card being used is yours, or that you have been specifically authorized by the cardholder to use it. All credit and debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment, we will not be liable for any delay or non-delivery of your order.

This principle also applies to other payment methods that may require authorization by the relevant payment service provider (such as PayPal, Klarna or other intermediaries). If such authorization is refused, we will not be liable for any delay or non-delivery of your order.

The applicable amount will be immediately reserved on your credit or debit card but will not be debited until the Products are dispatched. Please note that any charges applied by your bank or financial institution will be borne by you.

For certain payment methods (such as deferred payment providers or other intermediaries), settlement terms are determined by the relevant payment service provider and may require you to accept their separate terms and conditions.

We reserve the right to cancel any order at our discretion, without prior notification. This may include, for example, cases where your payment details are declined by the payment service provider, flagged by our fraud prevention systems, or where we reasonably suspect unauthorized or unlawful activity.

We take reasonable care to keep your order and payment details secure. Payments are processed through independent payment service providers who apply industry-standard security measures. However, except where caused by our negligence, we cannot be held liable for any loss you may suffer if a third party gains unauthorized access to any information you provide when accessing or ordering from the Website.

The Parties agree that jurisdiction over any disputes arising from or related to the use or breach of these Terms, or from contracts concluded under these Terms, shall rest with the court competent for the defendant or the court of the place of performance of the contract.
